Les parties ont été informées que tout changement d’exploitant d’un immeuble à usage agricole est subordonné au respect des dispositions tant des articles L. 331-1 et suivants du Code Rural que du schéma directeur des structures du department du Calvados, en date du 23 janvier 2001.

Si l’acquéreur désire à l’avenir exploiter le bien aliéné, il lui faudra, le cas échéant, obtenir l’accord préalable du Préfet.

Une éventuelle opposition du représentant de l’Etat dans le departement à l’opération alors projetée sera sans influence sur la validité et les conditions du présent contrat, la possibilité d’exploiter directement tout ou partie des biens objet des présentes n’étant pas une condition essentielle déterminante aux yeux de l’acquéreur de la réalisation de l’acte.
